Dr Amoa’s appointment was sponsored by the Secretariat under the Commonwealth Fund For Technical Cooperation. The Economic and Legal Services (ELS) Department has been assisting Sierra Leone in the establishment of an appropriate regulatory framework for Capital Market Development in order to complement that country’s private sector development and investment strategy. The terms of reference of Dr Amoa as contained in the in his appointment letter made available to the GNA, included undertaking as assessment mission to Sierra Leone as part of ELS’ team to carry out consultations with relevant officials and stakeholders. The Letter said the team was to develop a plan of action to assist the Sierra Leonean Government in the development of an appropriate regulatory framework prior to the establishment of a Stock Exchange in that country. It was also to advise on the development of the requisite measures including the enabling legal and regulatory framework and strategies to promote the development of Capital Markets. Dr Amoa was recently given an Honorary Doctorate Degree in Law by the University of Ghana, Legon alongside Otumfuo Osei Tutu II, Asantehene and His Eminence Peter Cardinal Appiah Turkson, Catholic Arch Bishop of Cape Coast Diocese.

Human Rights According to the last item on the newscast, the Nigerian government declared that it would arrest or “kill” anyone who tried to kidnap Charles Taylor. Taylor, who resides in Nigeria, is the former strongman of Liberia and a man responsible for much bloodshed in that country. He has also been indicted by the U. Special Court for Sierra Leone, which accused him of “the greatest responsibility for war crimes, crimes against humanity and serious violations of international humanitarian law” in Sierra Leone’s 10-year civil war. An international warrant for his arrest carries with it a $2 million reward. The Nigerian attitude epitomizes the way African leaders, even those who commit gross abuses of human rights, continue to be gently treated.

Damien Carrick: And what kind of evidence did the decision-makers, all along the line from the Refugee Review Tribunal, all the way up to the High Court, what kind of evidence did they talk about?David Manne: Well they looked at certain country information, for instance from the US Department of State, and also from the Department of Foreign Affairs and Trade in Australia about the attitude of the government and its practices towards Jehovahs Witnesses, and in that case of course the evidence seemed to suggest that there was an official respect for such religion, and also that there was no evidence of condoning of violence towards Jehovahs Witnesses. Damien Carrick: There are a lot of failed states around the world, places like say, Sierra Leone, Afghanistan; if there is no central authority which can provide effective protection, does that mean that therefore youre more likely to come under the refugee convention?David Manne: In part, yes, because at the end of the day, and lets go back to the Ukrainian example of the recent case: some of the critical evidence I guess which led to a rejection of the case was that there was no suggestion found in any of the independent evidence that the Ukrainian government was not in control of the country, nor that the police force and the judicial system were not I guess reasonably effective, and impartial. So those are key questions in any context where youre talking about non-State actors. Are there State mechanisms for the protection of people? Thats the key question, and are they effective? Now having said that, and youve referred to some other countries where those questions have quite commonly arisen, Sierra Leones one example, Afghanistan in recent times, another. What were talking about in broad terms are what are often called civil war contexts, and this is often where the question arises. Youre looking at a country in chaos, and stricken by civil war, where State mechanisms have broken down, are generally ineffective, and in particular the Rule of Law, so that for instance normal mechanisms, protection such as police, the judiciary, the Rule of Law, are ineffective.
