Fanny Ann Eddy, the founding leader of the Sierra Leone Lesbian and Gay Association (SLLAGA), was brutally raped and murdered while working late at her office in early October 2004. The 30-year-old lesbian activist did much for the fight against AIDS and HIV in Africa, and was a fearless.

One involved a Taoist leader who quelled an uprising by a Buddhist minority by damming the rivers that supplied them with water — a clear parallel with Saddam’s persecution of Iraq’s marsh Arabs. Washington appears to be committed to letting the Iraqi authorities deal with Saddam but the United Nations has expressed “serious doubts” that the special tribunal will meet international standards. Robertson argued last week that Saddam should be tried by a war crimes tribunal similar to that in Sierra Leone, where international lawyers sat side by side with local judges. “If Saddam’s trial proceeds under Iraqi law only, he may have to be released,” Robertson said.

Britain is not alone in its criticisms of the expense and delays of the Yugoslav and Rwandan tribunals. Indeed, it was the recognition that an ad hoc tribunal could not be created every time there was a need for one that prompted the establishment of the Court in the first place. The Sierra Leone Special Court, a mixed tribunal which includes both Sierra Leonean and international judges, is less expensive. But it was set up at the urging of the Sierra Leone government itself and can function only because of that governments commitment. Cooperation and commitment to justice are two things that Khartoum seems unlikely to provide. Even with strong support from the Sierra Leone government, the Special Court struggles because of a lack of cooperation from other states. Because of time and resource constraints, there is a real risk that fugitives from all of these ad hoc tribunals could escape justice…
Because Sudan has not ratified the International Criminal Court treaty, a special Security Council referral would be needed in the case of Darfur. Such a referral could well encounter the opposition of the United States, which loathes the Court. But it was created to address just these kinds of serious crimes. If the Court is kept out of the Security Council debate out of fear of the ire of the US, it could threaten to make the Court itself seem irrelevant when referrals are needed in years to come. Britain has a critical role to play. In the past, it has supported the Court, most notably when the treaty to set it up was agreed in Rome in 1998. In theory at least, that support still stands.
