He went on to state that the other portion of the party to which the plaintiffs belong will be affected, adding that if the plaintiffs succeed in their appeal motion, elections for national officers of the party could have been held, policy matters relating to the entire membership of the APC could have elected a presidential candidate and a running mate chosen who would have been of great expense to the party , especially if the entire process should be done all over again. Lawyer Serry Kamal also maintained that nothing will stop 1st and 2nd plaintiffs to be expelled because they are sympathetic to their faction. An evidence of this was highlighted when he referred the court to the letters written to the 1st and 2nd plaintiffs which sought to expel them from the APC on Friday 11th October 2002.
